A new law in Florida now prevents local governments from enacting or enforcing any ordinance or regulation involving EV charging stations. Senate Bill 1084 became effective July 1, 2024. Now, the authority to regulate EV chargers is exclusively held by the Florida Department of Agriculture and Consumer Services (FDACS).
Orlando had an existing ordinance requiring 10% of commercial parking spaces be EV-ready. The new Florida law is expected to invalidate local ordinances, like Orlando’s. The FDACS is considering a proposal to ban local governments from requiring EV chargers in any new or existing structures. FDACS also has proposals that would allow municipal incentives for providing EV chargers, another about permitting and zoning requirements, and one about state-level safety standards.
