HUNT Dimming has announced that the United States Patent and Trademark Office (PTO), comprised of a panel of three judges, has issued a precedent ruling in favor of HUNT, denying Koninklijke Philips Electronics N.V. (Philips) trademark application 79006105 for “SENSE and SIMPLICITY” in International Class 9 for opposed lighting goods, culminating a six-year process. The Board unanimously decided against Philips, determining that a likelihood of confusion existed with HUNT’s mark SIMPLICITY®, which has been in continuous use with lighting since 1985.
“The PTO has affirmed the validity of our trademark by determining a likelihood of confusion exists in regards to Philips and by denying their unlimited registration,” says A. J. Glaser, President of HUNT Dimming. “We couldn’t be more pleased with the court’s ruling,”
